Lawsuit against BSN supplements!

Ballsy press release--sounds like there is a lot more going on behind the scenes than is evident on the surface of the complaint--I also didn't notice any appreciable harm being alleged (didn't read it that closely)--they may have a real problem getting a judge to certify this as a class action.

Interestingly enough, a number of Supplement Retailers in New Zealand had similtanious clearance sales on most BSN products (up to 60% off) late Nov/early Dec.

Can't help but wonder if they got wind of this little issue and just wanted to dump their stock before the consumers got wind of any rumours.

Have to say my training partner would NOT have maxed out his credit card for 6 containers of NO-Xplode & 4 CellMASS if he'd known this info!!

The Lawsuit alleges that: 1) CEM3 does not exist in CELLMASS®, N.O.-XPLODE™ or NITRIX®; 2) BSN’s patent pending for CEM3 does not exist; 3) CEM3 does not exist; and 4) BSN is the alter ego of Chris Ferguson.

BSN contends that all of the claims made against it and Chris Ferguson are meritless and intends to vigorously defend itself against these allegations. The Lawsuit is based upon a single test which did not directly test for the presence of the CEM3 ingredient, by a laboratory that never contacted BSN for information about CEM3. Contrary to the speculation of Call Jensen’s lawyers, a patent application for CEM3 does indeed exist and is currently pending before the United States Patent and Trademark Office. no problem, i just never thought i'd see BSN having a lawsuit against them for something like this...like you said they did answer and i think it was a very professional answer too...it should be interesting if it goes to trial

I have afew buds whom work at BSN,,,, and this is not being taken lightly... like i stated, this isnt the first time it happens either. Sup companys are big business, and some will do whatever it takes to gain sales on their behalf, no matter what the consequents are....
