I don't have any scoop as to this matter, but I have been involved with these types of lawsuits. Most claim that the supplement involved is causing a particular physical harm that is common to all members of the class. I think this suit is just saying that the public is being sold something that doesn't work like it is advertised to work. True class actions require substantial similarity in harm (among other things) amongst all class members. If these supps work for some people (like they do for me), kind of work for others and might not work for some, and since the measure of what "works" is very ambiguous, it may be very hard for the plaintiffs to get a judge to agree that this should be a class action.
